  Former IRS CID Special Agent Joseph Banister Acquitted 
  of Tax Fraud And Conspiracy

  Government Unable To Prove U.S.  Law Requires Income Tax
  Withholding or Filing

Sacramento California -- On Thursday June 23, a federal jury found 
former IRS Criminal Investigative Division (CID) Special Agent and 
CPA Joseph Banister not guilty of all counts alleging criminal tax 
fraud and conspiracy related to actions he took on behalf of a 
California business owner who had openly defied the IRS over several 
years by stopping withholding of all income and employment taxes 
from the paychecks of his workers.

During the trial the Department of Justice was unable to put forth 
any evidence that Banister had either engaged in a conspiracy or 
had acted unlawfully when he shared legal research with business 
owner Al Thompson concluding that he had no legal obligation to 
withhold taxes from his workers or when he (Banister) prepared 
corrected tax returns for Thompson claiming his taxable income was, 
under U.S.  law, zero.

During the trial, Banister's former supervisor at IRS's San Jose 
CID office, Robert Gorini (who testified via video recording) when 
pointedly asked, was unable to cite any U.S.  law that required 
Banister to pay income taxes.

Banister, who was forced to resign in 1999, gave Thompson's worker's 
a presentation in 2000 which reviewed his detailed investigative 
research of U.S.  tax law which concluded that not only did the IRS 
lack any authority to impose income taxes on the workers, but there 
was no legal requirement for the business to withhold any taxes from 
the worker's paychecks.

Queensbury, NY – On January 25, 2005, the U.S.  Court of Appeals for the 
Second Circuit held that taxpayers cannot be compelled by the IRS to turn 
over personal and private property to the IRS, absent a federal court order.

Quoting from the decision (Schulz v.  IRS, Case No.  04-0196-cv),

    “...absent an effort to seek enforcement through a federal court, IRS 
summonses apply no force to taxpayers, and no consequence whatever can 
befall a taxpayer who refuses, ignores, or otherwise does not comply with 
an IRS summons until that summons is backed by a federal court order…[a 
taxpayer] cannot be held in contempt, arrested, detained, or otherwise 
punished for refusing to comply with the original IRS summons, no matter 
the taxpayer's reasons, or lack of reasons for so refusing.”

Without declaring those provisions of the Code unconstitutional on their 
face, the court, in effect, nullified key enforcement provisions of the 
Internal Revenue Code, stripping the IRS of much of its power to compel 
compliance with its administrative demands for personal and private 
property.  The court characterized IRS summonses issued under Section 7602 
as mere “requests.”

The court went on to say that the federal courts are there to protect 
taxpayers from an “overreaching” IRS, and that the IRS must go through 
the federal courts before force can be applied on anyone by the IRS to 
turn over personal and private property to the IRS.

And so much for the Founding Fathers' idea of a union of several
self-governing states that would delegate to a central government
only those limited powers needed for dealing with other nations 
in peace and war and for providing for the general welfare.   Well,
fellows, it was a nice try.  And it's truly sad to watch what 
was devised with such high hopes evolve steadily into a heavily 
centralized, ever more socialized government yearly expands
its control over the states and the people.   When asked what kind 
of a government the Constitutional Convention had come up with, 
old Ben Franklin must have had a premonition when he replied, 
            'A republic -- if you can keep it'.

As for those who would argue that the NRA, and other Second Amendment advocacy groups, are overreacting by suggesting the Left's ultimate objective is gun confiscation, one need only to re-read Ms.  Feinstein's declaration after passage of her 1994 legislation: "If I could have gotten 51 votes in the Senate...for an outright ban, picking up every one of them, Mr.  and Mrs.  America, turn them all in, I would have done it!"

Feinstein-Schumer is an affront to the constitutional right of all law-abiding citizens to own semi-automatic rifles for lawful purposes.  Please join fellow American Patriots on the front lines in defense of our constitutional liberties calling on Congress to reject renewal of the 1994 Clinton-Feinstein-Schumer Gun-Control Act.

Call your representitives and let them know how you feel.

No, those words are not the latest on Iraqi "regime change"
from President Bush, but the words of Prevaricator-in-Chief
Bill Clinton way back in 1998 -- four UNaccountable resolutions
and one 9-11 ago.   This is the same Bill Clinton who, after two
presidential terms of "ambiguity" with Iraq which created the 
mess we are in now, made a paid appearance with Bob Dole (rumored 
to have run against Clinton in 1996) on CBS (which "aided and 
abetted" Saddam Hussein).

Our enemies do not hate America, or even democracy, but freedom:  
freedom and all the spiritual and material wealth it creates.   
And the beating heart of freedom is capitalism.

I believe you can divide the people in to two basic groups,
those who believe government is a necessary good and those who
believe it is a necessary evil, those who want government to
take care of them, those who want government to leave them alone.

I believe government is a necessary evil and I want it to leave
me pretty much alone.   I think that's how the Founding Fathers
felt.   I think that the reason they wrote the Constitution the
way they did and then added the first ten amendments was to try
to insure the people against the possibility of being ruled and
controlled by an overbearing, tyrannical government.   

They failed.

They failed because all three branches of the federal government
-- the executive, the legislative and the judicial over the years
have twisted and ignored the words of the Constitution.   They have
turned it into a living document, which is another way of saying
they have turned it into a document that means not what it says
but what they want it to mean.   There are a few people who still
believe the Constitution means just exactly what it says.

Senate Must Reject Unjust 'Hate Crime' Legislation

Washington, DC - "The U.S.  Senate is considering a bill today that will
violate the concept of equal justice under the law." said Andrea Lafferty,
Executive Director of Traditional Values Coalition.

This disingenuously named bill, "The Local Law Enforcement Enhancement Act,"
S.  625 contains dangerous "hate crime" language...

According to Lafferty, while S.  625 is ostensibly designed to discourage
"hatred," this bill actually punishes a criminal who commits a violent crime
against a homosexual more severely than if he committed a crime against a
non-homosexual.  In effect, S.  625 creates a two-tiered system of justice
where homosexuals are deemed to be of more value than other victims of

"No one is in favor of violence against individuals because of their sexual
preferences," said Lafferty.  "But under our Constitution, no individual
should receive higher legal protections because of their sexual practices.
This law is clearly unjust and should be rejected by the Senate."

Lafferty points out that two legal scholars have criticized the philosophy
behind passage of "hate crime" laws.  Writing in Hate Crimes: Criminal Law &
Identity Politics, authors James B.  Jacobs and Kimberly Potter state that
hate crime laws are actually aimed at criminalizing a person's beliefs and
opinions.  "...  we are not only violating the American tradition of equal
justice under the law, we are punishing individuals for their thoughts and
speech when we pass hate crime laws."

TVC is urging defeat of S.  625 because it is unneeded legislation.  According
to Lafferty, supporters of this bill have failed to prove that local
authorities are not enforcing hate crime laws--and that there is a need for
federal assistance in enforcing these laws.  "Congress has yet to prove that
there is a need to expand federal hate crime laws," said Lafferty.

Contact your Senator and/or Representitive, and tell him how you feel.

This is an urgent call to the People to voice their opinion.

If you read nothing else from this web site,
about the 16th Ammendment, and all those
promoting a change to our tax system.

The 16th Ammendment actually changed NOTHING,
as stated by the high Court itself in the
Stanton v.  Baltic Mining decision wherein
the 16th is explicitly confirmed to have
conferred "no new power of taxation". 

So WHO cares if it was ratified!

OK, the subject came up again, tonight. "Did I say, "republic?" By God, yes, I said "republic!"  Long live the glorious republic of the United States of America.  Damn democracy!  It is a fraudulent term used, often by ignorant persons but no less often by intellectual fakers, to describe an infamous mixture of socialism, miscegenation, graft, confiscation of property and denial of personal rights to individuals whose virtuous principles make them offensive." Westbrook Pegler in the NY Journal American, January 25th & 26th, 1951 under the titles "Upholds Republic of U.S.  Against Phony Democracy" and "Democracy in the U.S.  Branded Meaningless." I hope you can see the sickening similarities between what's going on and the definition of democracy.  Slick Willy, Al Gore and all the rest of these idiots in the Congress and media pundits run around encouraging people to "promote democracy" in Russia and China and South Africa and Haiti.  <barf>   This is a travesty and I am ashamed that any representative of my country would go around the world encouraging people of other nations struggling for freedom to "promote democracy."
